Hey all,


So today, I am stopped at a stop lite in NYC in the S14. Its a sunny day, no rain/coulds etc.

The lite turns green, and the car ahead of me puts itself in reverse and slams into the front of my car.

To make a long story short, I got the other drivers info, called the cops, told em what happened, they filed a police report (other driver agreed with my synopsis of what happened - told the cops she was trying to parralel park and didnt see me), etc.

Now here is my problem. I do not have colission coverage. . . yet, i am not at fault and my car needs to be fixed.

I filed a claim thru the other driver's insurance carrier (Geico). They asked me to fax over a copy of the police report which i plan to do asap.

Will the other driver's insurance pay me to fix my car? I have never been in an accident where I did not have colision coverage.

Basically, how do I come out of this situation with a car that is fixed w/out paying for it? I always get skrewed in these situations. Should I file a claim in small claims court?

yes the other drivers insurance will pay for it.

youll just have to wait on them and sometimes they can take a while.
 
yeah, this shouldn't touch your insurance comapny at all. you will deal with her company exclusively. her liability ins will cover it, wheter you have colission, or not.

Yes, they should pay for your repairs in full. If they don't, take it to court. It's a clear-cut case of 'she fucked up your car, therefore she should repair it so that it is in as good of condition as it was prior to said accident'. Since the paint was all-original, and the car was valued with all-matching original paint, the car should be fully painted so as to not lose any more value than it will already from being in an accident that was CLEARLY not your fault.

Yeah true - i DID have the car appraised and at the time it had all original paint with no damage.

I hate these situations. Seems like I always come out on the bottom when stuff like this goes down. I really hope the cop's recorded our statements in this situation and put that into the report - that way if this turns into a game of 'he said/she said' I will be protected.

At least the Geico people seem helpful over the phone.
 
just bring the car to a reputible body shop.

it's YOUR choice where to get your car fixed.

if they say its too much, tell them you're bringing it there anyway, and that they are going to pay for it. don't take no for an answer. be polite, but be firm.
if who you're talking to keeps telling you now, ask to speak with her/his manager. keep going up.
 
I garuntee that they will not repaint the entire car, you're only going to get the new parts painted and blended with the rest of the car. If they do paint the whole car, they aren't going to do shit to prep it for new paint.

:werd: my friend used to work at the biggest body shop in town before he moved to Texas and he told me the same shit. They (insurance) will only pay for what is needed, not what you'd like them to do. Therefore, the body shop will only do what they are getting paid for.

yes, they did. it was entirely hassel free. 2 phone calls, and waiting for the work to be done.. thats about it.
 
Just go by America's motto, dude...when all else fails, sue the shit out of them.
 
usually a shop will give you an estimate on what it costs to fix all the damage. find a shop with someone you know that will do all the labor and a whole paint job for you for the same price as what a high end shop will do. if you know a shop that rapes people, get an estimate there. then go to a good shop and get an estimate for new parts and full auto paint. see which is cheaper. you might be able to get a whole paint job out of it.

sounds like a good reason to get an "angry eyes" or s15 front end. shit, it's probably cheaper than buying oem from nissan.

I figured about getting new front end parts . . . but It may take a while to get the parts - lets see how much I get from insurance and ill go from there.

Would that hold up in court? Geico has a duty to "perform" in that they must adequately repair my vehicle. Having 2 different colour's of paint on my car doesnt sound like adequate reparition.

Fuck that...that's what you do when YOUR insurance is the one paying for it and you want a full paintjob. Do the cop's usually record the statements of the vehicle operators as to what happened at the scene of the accident in their report? I may need some hard evidence that will hold up in small claims court if this turns into a "he said/she said" game.
 
if its reported on the police report that she was at fault then your ass is covered

you prob don't want your insurance company to hear about this but they will go to bat for you, its what you pay them for
if geico starts fucking you around just get your insurance company involved before you try sue'ing a big corp like geico

a good shop will be able to get the color to match, but of course it'd be nice to get the car fully repainted
 
The police report determines liability in any vehicle accident. As long as the P.R. states the other party at fault then their Property Damage Liability will kick in and pay to fix your vehicle at a reasonable expense. Depending on the year of hte car if it is determined it will take 80% or more of the cars value to repair or replace damage parts it will be determined a total loss into which the company will pay fair market value to you and then you can then ask to purchase the car back from the insurance company for a reduced rate if wanted.

As for the repairs, you'll need to find a reputable shop that you can trust. The body shop will work with you to understands your needs and wants but also needs to work in conjuction with the insurance company as their the ones actually paying hte bill. They won't pay for a full paint job unless it is warranted. A bumper cover, hood and fenders wouldn't warrant a full paint job as there was no damage to the rear of the vehicle. The insurance company will NOT put you in a better place then you were prior to the accident...
