He gets pulled over for "swerving" after he left a bar. Blow's a .079. Two cops are working him. Good cop is like well he's legit, let him go, and the bad cop is like no its just off because its cold outside. Legal limit is a .08 here in WA. Cop takes him into jail. He blows a .063. Sat in the drunk tank until 10 this morning.....

Got served and given a court date right there.



Blow's ass for him. Not sure what's going on here, but he already contacted a lawyer.

i dont think the cold has anything to do with what he blew on the breathalyzer. they were just looking for an excuse to put someone in jail. good luck to your friend
 
if he blew under the legal limit then he's alright, he'll just have to get a lawyer and fight it..
 
Lawyer up, fight it, sue the city/PD.
 
look guys there all kinds of myths when it comes to cops and the law, my dad is a cop and im almost one, it dont matter what he blew its up to the cop if he blew the lowest number ever he still can be charged with dui, if the cop feels that you have had to much to drink and its afecting you, you can still be charged no matter what number you blow so its up to the cop.

So whats the point of a legal limit?

True, and I know this from my days as a cop, but due to the fact that he blew under the limit and then much lower once he got to jail, the cop is now going to have to come up with a valid reason for the arrest for why he felt it was neseccary to arrest him. Main reason, did you feel he was a threat to himself and other drivers, did he perform fst's, did the driver fail? That is if this guy gets a descent attorney, in which case the cop just made a lot more work for himself.

well that is a double suck for him. he has to miss work, no pay, pay for a lawyer. if i was him when he is found not guilty i would sue the shit out of that police department.
 
there is a huge difference between driving under the influence and driving while intoxicated. both suck, but the penalties are way different.

Get the other officer on the stand. Get him to admit that you passed a sobriety test.

is this like a psychologist telling the patient to come out and admit it's him he's talking about? haha

anyways, if you pass a field sobriety and blow under .08, there is no reason to be arrested.
