ok, here goes...

Saturday night, me, my girlfriend, and my son are on our way to In-N-Out Burger. I'm at a red light in the middle lane. I'm at the front, there are cars in both lanes next to me and cars behind me. About 100 ft after the intersection the right lane ends so the cars have to merge into my lane. The light turns green and the car in the right lane takes off so they can merge in front of me. They get in front of me and in front of them I notice that there are a group of cop cars blocking off all the lanes going in the opposite direction, plus the far left lane on my side of traffic and one cop car is sticking out a little into my lane. So the car in front of me slows down and start moving over to the right a little bit so we can avoid hitting that one cop car sticking into our lane. All of a sudden he decides to slam on his brakes for who knows what reason, so my natural reaction is to move to the left and accelerate around him because if I slam on my brakes, the cars behind me could rear-end me and possibly cause a pile up.

We were traveling at about 30 mph and while I accelerated passed him I got to no faster than 40 mph (40 was the speed limit BTW) then all of a sudden i see two cop cars come flying up on me. So i pull over, take my license out, roll down my window, and while i ask my girlfriend to grab the registration and insurance, one of the cops walks up and says that all he needs is my license. So i give it to him and in his typical cop attitude he starts to talk to me like i'm a dumb ass and eventually asks me why I was speeding. I told him what happened (while speaking to him like he was a dumb ass because i'm not gonna let anyone talk to me like i'm some retard who doesn't know what's going on) and he says so "my solution was to speed up and endanger other people's lives" I told him that given the situation, I did what I felt was the best thing to do and that I never actually got above the speed limit.

He writes the ticket and still with his dick head attitude he hands me the ticket and says "red box please." I'm trying to read the ticket while his bright ass spot light from his car is blinding me through my side mirrors and he raises his voice and says "I said the red box" So i yelled right back at him that "I wanted to read and look over at what I was signing first." So I can tell he got irritated that i was right so he lets out a long exhale and shines the flash light at the ticket and points out what i'm being ticket for. It says "excessive speed through traffic accident" Keep in mind the accident is on the other side of the road and what I was trying to avoid was the retard who slammed on his brakes and get by the cop car sticking out into my lane.

So do you guys think i can win? I'm going to fight this regardless since the worst that can happen is that I have to pay for the ticket and there is no penalty for losing. Hopefully he doesn't show up and the ticket gets tossed out or the judge can see that I made a smart, good decision and tosses it out.
 
it's hard to say if you can win against cops. excessive is a judgement call. i would consider the 200-400 bucks it would cost for a lawyer.

well, to fight a traffic ticket in LA, you don't need a lawyer so i'm ok in that sense. If I win, it'll cost me a $10 dollar court fee, that's all. Compared to $400 or so, i'm sure anyone would try and go the $10 route lol Worst case scenario is that i lose and end up paying what it was cost gonna cost in the first place.

Many police officers have said this in the past. Are you the bigger man because you could cop an attitude with a police officer who was making a discretionary judgment call or did you just earn yourself a ticket for acting like a punk?

A little respect in this world goes a long way. "Please" and "thank you" are wonderful words that many tend to forget.
 
we can have this discussion many many many times as we've had in the past and will again in the future.

the cop was a dick. the cop was nice. i was wrong. i was right. etc etc

noone can really know without being there right?

seriously tho gotta play nice with them. untill you get to court, and the object here is not to go to court, they are right even if they are wrong. if you're nice maybe they won't write the ticket. if they are wrong and write the ticket, you still get the ticket, and now have to proove that they are wrong in court.
 
Sounds like this might fall under the Basic Speed Law. Never go faster than is safe for the conditions. Like with rain, you might feel safe only going 5mph under but a cop might feel that 10mph under is safe. He's right because he's the long arm of the law. Maybe talk to one of those lawyers that gives a free consultation.

Also, even when a cop is being a dick to you, try to be polite to him. You don't need to be and I know how contradictory that sounds coming from me, but sometimes they'll write your ticket for a lower speed or just not give you one at all if you're cool with them.
that's the thing though, the accident was no where near our side of traffic. It was a cop car sticking into our lane. This cop car wasn't blocking off anything, he was behind another cop car. As far as the attitude goes, it was one of those heat of the moments thing, I'm not gonna show anyone, ANYONE, respect who isn't gonna give me a little.

Also, he didn't write down a speed. all it says is "excessive speed" that's it

Respect is earned, not given. He showed me none, he got none in return. Ask anyone who knows me, i'm one of the coolest people you'll ever meet but at the same time i'm not gonna bite my tung for anyone. I didn't just start shooting my mouth off. His actually first question was "where are you headed?" he asked me in a dick head way and i answered him back in a normal tone "In-N-Out" then he still gave me an attitude.

Maybe if I absolutely thought I was guilty I probably would have stayed calm but I felt like I did the right thing and he was gonna try to punish me for it.

I bet you if I slammed on my brakes and caused a pile up, that same cop would of said " why didn't you speed up and go around him?"

Oh, are there any technicalities that can help me? Under Race he put H for hispanic, i'm not hispanic, i'm a flip lol maybe i can get him for stereotyping? :lol:

See, that's the thing you have to understand about cops. They think that having that badge on their shirt or belt automatically makes them respected. If you don't, they assume you think the law is frivolous, or that you are above it. Unless you have the resume or cash to prove it, you will surely be cited.

If you KNOW the laws... and call the cops on their mistakes, you will piss them off, however, when you take it to court, you cite the same laws and they will be dismissed. Cops don't like to be told their not doing their job properly, or that they don't know the laws. It's their JOB to know those laws. Who are YOU to tell them their wrong? (That's what they think, anyway) They will try and tell you this and that, but ultimately, during their whole speal, you should just be courteous. Why? When you go to court, explain that you were courteous to the officer, wished to explain your situation, but were denied and not shown any sort of manners on the cops' end, he looks like the idiot. Cops also have to uphold a certain code of conduct. If it is proven (by audio or otherwise) that you were in fact being nice to him, the judge does take that into consideration. I do know this from personal experience.

Good luck fighting it, but next time, it truly does help (even if he's being an asshole) to be nice. Don't lick his ass or anything...

I've been the first to greet the officer as he approaches 'Good afternoon/evening/morning, sir.' And you can see their facial expression change. They aren't used to being treated nicely. In fact, they commonly see people act rude to them, so, you just were another 'one of those assholes' to him.
 
That would have been my next point. You don't have to like him, you don't have to respect him (or her). But make him (or her) think you do by just being nice even if you have to act.
 
The ONLY leg you have to stand on is that the car in front you slammed on brakes so you sped up a little to get around them...and you don't really have any proof that it really occurred...and if its your word against a cop's word...the cop wins...

other than that...you have nothing...and it definitely would have helped to be nice to the cop...sometimes if your nice to the cop...but the cop still gives you the ticket...he will not show up on that court date...and you get an easy out...BUT...on the other hand...that cop may remember you...since you were disrespectful to him...and that may have given him an agenda to make sure you have to pay for that ticket...so hes gonna be there...

Ive had my share of being pulled over...and I've always been nice to the officer...the time that sticks out the most to me was when i was racing someone on the instate and we were going 120mph...sure enough we got pulled over...i thought i was screwed...but i was nice to the cop...it was a lady too...so maybe my charm helped...werd...lol...jk...but yea...she told me she was gonna let me go with a warning that time...whew!

i switched my whole attitude around in court and apologized and it made a world of difference
 
Listen, regardless of whether or not someone is being an asshole to you - my point stands, it goes a long way to be the bigger person and show a little respect.

I may not always heed my own advice, but it would truly make the world a nicer place if people were capable of sucking their own emotions up sometimes and doing the "right" thing as opposed to stooping to an other's level.

You wouldn't have dropped dead from being respectful, the police officer might have changed his tune a bit, and you might not have gotten a ticket.

Instead you had to pull the "my cock is bigger than yours" card and stoop to his level. In the end, what benefit did you gain from acting in such a manner? The ability to say that you don't allow people to talk to you disrespectfully? So what, literally the biggest man in the world will always have smaller people speak condescendingly about him.
 
Back to the issue at hand...

Go ahead, fight the ticket but once again its up to the officer's discretion and the majority of the time, the judge is going to side with the person who has been trained to make such judgments and sworn to uphold the law.

In the court of law, an expert's word (here, an officer) holds more weight than your own personal opinion.

From the little I know about the incident, from your text, it would appear as if you're in the wrong. Even if you were to pass him on the side, you didn't need to speed up to pull along side of the other driver, you could have done so at a slower speed especially when there's emergency vehicle lights nearby.

When emergency vehicles are present, new rules and regulations are in force. This idea is akin to the idea, "the mail must go through" meaning that other vehicles are supposed to yield to a federal vehicle, the mail truck. The same is to be said for emergency vehicles. My housemate dealt with an officer on a trip and was ticketed for going around a police cruiser that had its lights on and had another vehicle pulled over because when the officer went to pull back into traffic, he hesitated and my friend thought he was yielding so he "passed an emergency vehicle."

I thought i mentioned that they didn't have there lights on... anyway, the cops cars all the way on the other side of the street had their lights on. The cars sticking into our side of traffic had nothing on that's why i couldn't actually tell what was going on because the lights that were actually on were kinda of blinding us.
if i didn't speed up and go around him, i would have gotten sandwiched between the car that slammed on his brakes and the back of the cop car sticking out into my lane, I HAD to speed up a bit.

I talked to a co-worker last night who's brother in-law is a cop :) he gave him a call and he said that i absolutely did the right thing when the car slammed on his brakes but unfortunately to someone who is on the outside looking in, it looks like i was just being an impatient prick. He also proceeded to say that the nice guy routine actually pisses off 50% of officers because it seems like you are trying to kiss ass. However, he said being nice is always better. although he understood that my emotions were high given the fact that i just avoided an accident.

Anyway, he's gonna look into it and try to help me so he said to expect a call from him in about two weeks.:D:D
 
He was correct when he said 'it looks like you're kissing ass' but those in that percentage didn't do it properly. Just be a polite human being. Besides, the other 50% of officers love their ego being stroked. So, you can't really lose. Maybe it's just because I'm a female, but I've seen their demeanor change when greeting them and just being polite.

Also, when at all possible, I like to keep it to 'yes' or 'no' answers. That irritates them more than anything sometimes, as they're usually trying to get me to admit fault somewhere, but there's nothing they can do about it... lol

cop "oh you think your funny huh? why dont you hand over your license and registration"
me "im not handing over shit until you tell me what the fuck you pulled me over for"

cop "get the fuck out of the car before i taze you"
me "go ahead and taze me, but its not going to make your dick any bigger"

i figure by that time i should be getting the shit kicked out of me... so there wont be much more dialogue at that point

ill try to get it at least on audio for you guys

All points taken... i'm not trying to justify the attitude, it's just what happened in the heat of the moment. You live and learn. We'll see how it goes :)
