do I have a case?

So I made my offer on the house I'm buying in Jan, to close at the end of Feb (This Friday actually)

the offer was countered, accepted, inspection ordered and completed quick as a hiccup. Then I got everything the lender needed and gave it to the broker, approved the prelims, they ordered the appraisal the end of the last week in Feb. (I was in the military, I do things really fucking fast)

(next part is as per the mortgage broker who's a family friend) So the inspector, knowing they have till the 29th to close, back burners it until the end of last week. They do the appraisal on last Friday, she comes into work Monday morning and her computer is fragged. Now the paperwork won't be ready until Wednesday (at the earliest), but most probably Thursday.

If that's the case Closing goes from Friday, to no earlier then Monday or Tuesday

Problem is I've already confirmed my delivery date on the appliances Sears is delivering, and I'll have to pay more rent (prolly prorated but I can't clean the place till I move so we're looking at a week at least which is a couple hundred)

so this ladies' negligence has just cost me $300, should I go after her for it?

write it in.

i got my sellers to refund me $1500 for pushing the date back 2 weeks because they weren't ready to move in time.

It isn't any fault of the seller so I'm not writing it in, that's like suing walmart because you got hit by a drunk driver in their parking lot

don't pay the appraiser

also not an option, if the appraisal has already been released it's already been paid for and figured into the loan, that being said my only recourse would be the seller, which as I mentioned is not an option...

If you had it in writing that it would be inspected by a certain date then yes you might have a case. If i were you i would consult with a lawyer.

don't pay the appraiser
here in houston there wont me any appraising until you pay thats what my realator told me they were tired of getting ripped closing penaltys are a beotch especially when you give them more than reasonable amount of time to get it done id fight it till the end man

I'd call up the appraiser and discuss matters.

If they gave you a written commitment then I'd look into it more seriously.

update

now due to the snafu the seller has to make nother house paymentn they're pissed too
why would they be pissed? they are a couple days away from getting a shitload of money.

you have a case if things are in writing and it is PROVABLE that they were negligent.

...because if they haven't closed on the house by XX date, then they have to make another mortgage payment to the bank, in order to keep their loan and their credit in good standing.

Thats an extra XXX (fill in the blank, $1200? $2400?) that the seller needs to front to the loan company, while still only receiving XXX amount from Silver.

Also getting a "shitload" of money is relative. The market isn't seller friendly at this point in time and if it was a recent house flip or move-in, in the last 5 years then the seller likely does not have much equity built.
