cliffs: i backed up into a pull off area so the cop going to pull me over wasn't standing in the road in traffic
i get a ticket for unsafe backing.
note: no other cars on the roadway besides the cop and myself, i used my signal, and my mirrors and looked behind me as i backed up.

So Saturday I am driving home from work.
I got to make a right turn onto the next road, and i pass by a cop (village, nothing better to do type cop)

He's at the end of his road, but as I look in the rear-view I can see no signal, and he is not turning right or left, it looks like he is swinging around.
I have a broken corner on my accord that kinda just hangs in the breeze, but the light is still operational and visible, it just sits away from its original location by about an inch, the tabs are broke.

So i drive along and make my next left, taking my normal route. The road kind of double back so I can now clearly see the cop is coming up behind me. This is a narrow country road with no shoulder and blind turns that car usually cruise along on. So i just pass a pull of by about 20 feet. So i stop, put on my right blinker, and back into the pull off, so that the cop inst standing in the middle of the road when he pulls me over.

So the first thing the douche-bag says is why are you backing up, and I explain my logic to him, that it was a professional courtesy to keep him out of harms way.
He points out my blinker, and my registration is half hanging on the windshield because NYS was cheap and used shitty materials so they always fall off now.

So he goes to his car and is there for a good 20-25 minutes.
He comes back to my car, and says I'm gonna let you slide on the blinker and registration ticket, here's a ticket for unsafe backing. Moving violation with points.
And i just look at him and ask him... you're really giving me a ticket for backing into this spot here when i was just trying to keep you from standing in the middle of the road? and his reply was that i did not know that he was coming after me since he did not have his lights on at the time. So i was not doing him any favors.

Anyone have an opinion on this?
I was 110% polite and respectful. I don't play games with the cops or any of that bullshit to make him angry with me.

my opinion is that is bullshit. definitely take it to court, what a prick. gives you a moving violation instead of a non-moving violation?? how the fuck is that doing you a favor? especially when you were trying to help HIM out?
 
Yup, take it to court. Hopefully if the cop does show up, the judge will ask him why he was being a prick to a citizen that had the officer's safety in mind.

Incidents like this are why people dislike police officers.
 
yea, i was actually beginning to like cops
realizing they are just doing their job blah blah blah
but nope, back to fuck cops
its really a shame cause half of my family are cops

and most courts in NYS don't have the officers show anymore
they dont want to pay overtime
so they have a DA, or special prosecutor, that steps in for the states side
it doesn't really change much(still the same under the table plea deals so they get their money), but if it was the cop, he would have definitely dropped it in court after i guilt tripped the fuck out of him after he handed me the ticket
 
For every 'good' one, there are 5 just waiting for you to fart the wrong way so they can throw their weight around and be a jerk.

Fight it. Guaranteed the judge or magistrate will see your good intentions and throw this thing out. I got bitched at once for failing to pull over when I was trying to go beyond an area with no shoulder. Fortunately the cop realized this when running my plate an apologized.
 
i got pulled over on a main 4 lane road once. i didn't stop and pulled into a parking lot. cop asked, "why didn't you pull over on the road?"

i replied, "well, there is a ditch on the right, and on the left there is a lot of traffic. it's saturday night and might be some drunk drivers."

he said thank you, checked my papers, said he liked my car and let me go. i think i was going about 10mph over.

another time i had a cop call in 3 other cop cars and ripped me for driving an extra 50 yards instead of immediately stopping. i replied with, "if i stopped right when i saw the lights, we would be blocking all of northbound traffic. my wheels are 6 inches from a sidewalk".

he told me "it doesn't fucking matter, stop when you see the lights".

all he could hit me with was no front plate. he was a dickbag. the other guy was cool.

yeah, they do shit like that all the time.
here, you get some that will be like that, but not in all cases.
there was a huge story a couple of years back, an elderly lady was being pulled over by an unmarked car on a back road. she acknowledged him by putting on her blinker and slowing down but kept going til she found a public place to stop, in case it wasnt really a cop.
not running by any means, unless chases take place below the speed limit.
but when she stopped he ran to the car and yanked her out, threw her on the ground rolled her over and cuffed her. then made her lay there until backup arrived.

i believe she won the lawsuit.

here, they instruct us in the drivers safety classes, that you are required to go to when you get a moving violation, to keep going until you find a public area. if you are on a backroad, or just somewhere dark where it would only be you and the car pulling you over, they tell you to acknowledge but keep moving until you get somewhere public.
problem is, they dont seem to be instructing their officers about this.
 
fight it... ive been to court in NY a few times for traffic shit... they are pretty reasonable once they see that you are not one of the unregistered, uninsured, unlicensed, illegal citizen, drugged out, dickbags that they normally have to deal with

Fight the ticket, tell the truth, be respectful to the judge. Dress decently, the courtroom is always full of scumbags with no class - show the judge that you do not deserve the same treatment as the repeaters do.

i know my way around NY's traffic court system

i just thought it was so unbelievable that i had to share my story

i have had a real clean record recently, no points on my license etc
a few weeks back i got pulled over 66/55, my truck speedo is off because of the big wheels, i figured it to be about 10 mph, so i cruise at 50 and assume about 60mph which no one bothers you about
he gave me broken speedometer, was just looking for drunk drivers

and then i get this guy

so much for keeping a low profile
 
moving violations = points

used by DMV to keep track of you
if you get 12 points in 18 months they take your license away, or something to that effect
or 3 speeding tickets in 18 months, same thing

1 point = 10% increase in insurance on average
for example
failure to obey a traffic control device aka running a stop sign/light = 2 points = 20% increase
 
well, i guess they changed it from the last time i got a 20+mph ticket dropped to a stop sign

The Effect of Points
If your point total reaches 11 points or more based on the calculation described above, the DMV notifies you and suspends your driver license.

Insurance Company Points and Out-of-State Violations
Insurance companies have point systems that are different from the DMV driver violation point system. The two point systems are not related. Contact your insurance company about their point system.
