    last time i checked....

    copyright infringement is a serious offense which can lead to thousands of dollars of fines....

    im sure the good folks at the hondaaccord website just made an honest mistake and will take down the content in question asap.

    umm im not schooled on the law regarding the internet, so someone please correct me if im wrong, BUT from my limited understanding of it, the webmaster of the accord site would have to fly out to where Brian lives (conneticut) in order to defend the lawsuit against him....

    it would never make it court and it's general knowledge that can be gathered from other places on the web. there isn't a big difference between them doing that and us using smilies created by other people w/out their permission.

    brian, if you want to protect your content put it to into gifs or flash movies so the info can't be copied an pasted.

    its one thing to use the freely availble data-

    it's another to DIRECTLY copy/paste my code. look at the rest of the site, and then those tech pages. They are OUR font- not theirs. it's a 100% copy paste, and THAT is what I'm going after- not the data as much.

    As far as the data being readily availble- good luck finding HALF of what w have in our reference section anywhere else.

    i'm not defending them or saying the info is easy to come by, however it's still general knowledge. i'm just saying you using other people's smilies isn't any different from them jacking your reference page.

    personally, i'd contact them in a nice way and tell them you'd appreciate it if they would remove your content from their site. just like if some smiley creator wanted you to remove one of his/her smilies from your website.

    good job. you might want to save copies of their html files and take some screen shots of their site while you're at it incase you have any problems.

    ok, i did not read this whole thread, just down to this post .....so i may be missing something.....

    BUT

    originally i did agree with you in the fact that the wheel weight and what-not IS common knowledge and not original content.

    THEN brian told me of the months he and his friends spent preparing the list and what not. that IS original content in my view and his copyright was infringed.

    im not schooled on copyright laws and the internet (yet) i can and will ask of my teachers (attorney)

    her husband is a copyright and patent lawyer and she is a business lawyer.

    but my initial diagnosis still stands.

    brian DOES have a case against these fuckers.


    altho you are right. this will never ever goto court. i just put that up there in the unlikely event that their webmaster would come to this thread and get scared....

    if anything, they will setlle out of court....but again, this will not happen. im sure they will take the content down and that will be that. no lawsuits, no payments being made nothing.

    you guys got to realize that brian too has to hire an attorney , not some piss-poor lawstudent like myself. and that costs money....and time.

    bah.
