I wonder if the same logic applies with searching a vehicle? IE: I've not consented a few times to vehicle searches, and the officers didn't bother rather than getting a warrant. Wiretapping warrant for recording you during a traffic stop?
 
if the guy fights this, and he has a damn good attorney, then he has potential to take this all the way to the supreme court and change the laws.
we should be able to record both video and audio of police officers at any time for any reason.
