Renting Question...

    Ok so I finally got the check for my security deposit from Golfview. It's the 28th and we've been vacated since March 31st around 2 pm.

    On march 1st, I walked in to put in our 30 day notice. Since there was 31 days in march, i figured the first would give them their 30 day notice. It says "at least" 30 days, so I got there within the at least.

    Now, when I opened my check I noticed it was for $139.00. My security deposit was 199, of which I paid 119 and Matt paid 80 of. They had notes stating that the notice to vacate was given on the fourth, and thus we were charged 60 dollars.

    This is the terms and conditions of the Notice to vacate on my written and signed lease I am still in posession of.

    I think I have every right to contest the 60 dollar charge because I gave notice to vacate on the FIRST, which is 30 days prior to my last date as a tenant. However, because matt was in North Dakota and working he couldn't call in until Monday (the 4th which is what they're stating) to agree and correspond my necessity to move out. However, he was already completely moved out by this time.

    Now if you turn your attention to what I have underlined. My take on how that is worded is this; once I gave them our notice to vacate, that means it is their understanding that both tenants (matt and I) agree to this notice to vacate, and thus, my written notice is sufficient to pass the 30 day notice required.

    This means that the 60 dollar fee they took is far beyond ridiculous.


    Opinions? Otherwise I'm going to show up there on Monday to contest it.

    do you have proof that notice was given on the 1st and not the 4th?
    if so then definitely contest it and get your $60
    shit contest it any way
    worst case, you end up where you are right now
    you have nothing to lose
    i say go for it

    That is the shitty part is you must some how prove that notice was given on the 1st. Is it possible that they you and your roommate could have spoken with two different people? Because it may just be a simple misunderstanding.

    I called matt the day I was in the office to give him the number and the lady to talk to when he called to concur on the notice.

    I know damn well it was the first because it was a thursday which is payday and I did it around 2-3 pm.

    I signed my name on their "written notice" form, and I'm pretty sure I put the date on it as 3-1-07.

    I told her that I know it was supposed to more than a 30 day but that isn't the way it was written and I've been too busy to stop in or call. She said "you should be fine". Well that verbal statement was a load of BS.

    I'm not going to go to Matt with a check for 139 and say you get nothing because I need this more than you do. Because yeah, he has to sign it before I can cash it. That complex and those two ladies... waste of money.

    I doubt it was the 2nd (friday), but even so... 29 days is enough to penalize my deposit for SIXTY DOLLARS?

    dont worry about it... cut your loses. Shit driftspeed riped you off more than that. Or hell... sell a bag of baby powder as a gram of cocaine... your make it back ;)

    It's not over with driftspeed...

    I'm not about to even bother cashing this check because matt is going to want his 80 which leaves me with a whopping 59 dollars.

    So no, I'm not going to cut my losses. I could really use putting 100+ towards a credit card.

    i'd say matt gets nothing, as its his late ass that caused the issue.

    I didn't really want to give him any of it anyway. Since I'm the one that paid the most for the apartment, and took care of all the arrangements for cable/electric and then having to go put in our 30 day.

    ... but I need his signature before I can cash the check anyway.
