    Someone posted a link that read K-Pro logs or something on PGMFI. They didn't take it down fast enough. Now Hondata wants to sue for loss business.

    I may be wrong though.

    Yup, they're trying to hold the admin responsible for what a user posted.
    I thought that would be covered by a disclaimer.

    i'd say something about Hondata, but they'd probably try to sue me too.

    Needless, i think it's a lost cause. there's already precedent set that admins aren't responsible for user-generated content. I posted some links on the pgmfi site

    We already boycott Hondata. Why use a product that costs money when you can do more for free? We have told many of our customers to sell their Hondata and we tune them on Crome unless they're adamant about keeping it. We find that a lot of the time (ESPECIALLY with K-Pro) that it just sucks... it's too bad that there's not much aside from K-Pro to use.

    like i posted over there, it won't hold up. there's already been precedent made in 4 or so court cases that have all setteled/won in the website owner's favor that user-driven content is NOT the responsibility (legally) of the forum owner, unless it is media (mp3, wmv, etc)

    The only thing I noticed is that most of the links you posted were non-us. I didn't read to much but didn't notice if they were US cases or not.

    Regardless, its a useless headache and I feel pretty bad for the guy.

    Although, it was pretty ballsy for him to sell the site knowing the situation. I'm sure if it was settled last year then it would have been okay. I really didn't see too many potential issues with HD's request to him...

    i still don't know why someone would even buy that (it doesn't even run ads... lol)

    but anyway, yeah, most have been is aussie or the uk, but if there's anything the aussies do right, its the web. From a group, i've found the aussies to be way more cutting edge, followed by the uk, and then the US tends to follow suit in a little while. I think it will only be a matter of time before its the same here in the US.

    Understandable from the web perspective, but their judicial systems are much different than the US. UK is comparable, but seems to be much more leniant on "frivolous" cases such as these.

    The US is sue happy :(

    i'd like to see a hot shot lawyer try to turn around the target case, saying that pgmfi was simply making their code more accessible :D

    Isn't Hondata taking info or programs that Honda produced....turn the tables...get Honda to sue Hondata.

    on their website...first thing they say is "Hondata modifies standard Honda engine computers (ECUs)"

    uhm...isn't that like taking a I-phone and making it into a user friendly (hacked) phone?

    does hondata have any real legal rights to reprogram Honda equipment and to actually turn a profit off it? And to make cars less roadworthy in an EPA standpoint?

    probly not but I'm sure honda won't discourage it. the more people that want a "cool" honda the more cars that they sell.

    so lets see this as a big picture....

    a few guys hack Honda's Research and development on some ECU's, program a fix so kids can use their new ECU's to get more power and less fuel economy than what Honda originally configured for the said ECU's, and they make a company selling hacked ECU's to the general public to replace normal good to go normal ECU's, that is against the main StandPoint that Honda was set for....Their company is for fuel econmy and reliability, not tuners and speed...thats what Mugen is for. And this company developed a fan based forum, and someone on that forum took the proprietary info that the original hackers took from Honda, and posted something that was cheaper on a different website, and they made a forum and blah blah blah blah....

    Does Hondata have an actual "OK" from Honda to actually use their products, R&D, and licensing to actually stand behind their hacked ECU's and to sell them fully knowing that they are "modifying" said known Honda byproducts to be driven on "off road conditions only" when their major users are really driving them on the streets and in general public?
