So I get an email when I'm at lunch yesterday saying that the hiring lady needs to talk to me when I get back. I call her when I get back and she says that "The FBI found a hit on your fingerprints and you need to go talk to HR at 2:30. But you don't have to worry about anything." First off, if you ever get a phone call like that, your worried right away... I was scared shitless trying to think of what it could be... So I go tell my boss, and he was like, the last person that went to HR with that lady did not come back, which did not help the situation anymore... So 2:30 comes around and I go to the 46th floor of my building to the HR dept. I meet this lady and she goes " you might remember when you were hired, we took your fingerprints. Well we send those to the FBI to make sure people arent hiding anything from us and we also do it just to make sure your legal." I said, "Yes I remember." She goes, well we got your report back in August and there was a Hit on it from the FBI, but it wasn't that serious so we didnt say anything till now. I'm like ok, so it cant be that bad if they waited 6 months to tell me about this. She hands me a copy of my FBI report because they have to do so. She goes can you explain this charge of "Retail Theft" on your report. I instantly knew what she was talking about. Heres the story on that one. In 2005/2006 I worked at Advance Auto parts. We all have our own logins, which we all used everyones, Managers used ours, we used managers. Dont know why, but we did. Well this kid comes to me and says he found a great way to steal money from the company, and I told him I want nothing to do with it, and I suggest he doesnt do it. He says, "yeah its pretty stupid." I figure end of conversation.. well a week later I get pulled into the back office and the Corporate Security guy is there, and I didnt know who he was at first because I never met him before.. Apparently the kid decided to do his plan anyways, and he did fake returns and took the cash.. Well he decided to use my ID and login for the computers and do them under my ID. But he did them under his ID as well. He did over $1000 in fake returns in my name.. They asked me about it and I said I had nothing to do it. They didnt believe me, and they called the police in to press charges against me. I swore up and down that it wasnt me and that it was the other guy and they still didnt believe me. Well, they ended up firing me and took me to court over the $1000 and tried to get me charged with Retail Theft. I got a lawyer and told him everything and what happened and my lawyer goes "will you take a lie detector test to prove this?" and I said yes, because I know I'm innocent. He goes ok, if it goes that far we will do it.. Well they charged the other kid as well and tried taking him to court also. That day in court, the kid admitted that he used my ID. They dropped all the charges on me, and that was the end of that. BUT, because I was charged with it, I had to go get my fingerprints taken, and it was on my record. So even though the charge was dropped, the FBI still considered it a hit on me.

So I have to go to the court to get Disposition papers, proving that the charges were dropped within 2 weeks or I lose my job. Even though, right on my FBI report it says "Not Convicted/Nolle Processed/Withdrawn. But I was like, ok, if thats all it takes to keep my job, then I will do it. I work right next to the courthouse so its not like I have to go out of my way to get these papers.

But what I dont know is, Will the county courthouse have my papers, or will I have to go to the courthouse where I had my trial? If I have to go where I had my trial, then it is out of my way, but still no big deal, because I like my job enough to prove I was innocent and keep it.

So that was my day yesterday.. Everyone I work with was scared shitless for me because my boss went around telling everyone I was fired. Which I wasnt to happy about, but whatever. I work with cool people so its ok.
 
dont' be as worried about losing this job, (which you wont) be worried about explaining why you got fired. i have to go through this every time i interview. i pretty much had a similar situation.

get it resolved no matter what. you didn't do anything wrong and the court found it that way. for what it's worth, they can't fire you for not claiming it. you weren't charged. check your application. it will say have you been CONVICTED. they can't fire you for false application for just a charge.

guilty until proven innocent huh?
call a lawyer and see if this is some form of harassment

looks like they are trying to find a reason to get rid of you
 
The lady said they do it to everyone. They send everyone's prints to the FBI, and if something comes back they give you time to prove that you were innocent. I have 2 weeks to prove it. If they were getting rid of me it would be easy. I'm a contractor for them so all they have to do is call my company
 
they can't fire you for a record. thats illegal. plain and simple. they can however fire you for saying that your record is clean, and it has a blemish. two totally different ballgames there.
 
But it is clean technically isnt it? Since it was dropped from me, and I never got convicted of it?
 
Oh, BTW PA is a right to work state. They don't need a reason to fire you, but we do have to pay a right to work tax.

yes, it is clean.

if you have any questions, you can request your entire criminal record from the courts. it's kinda like a credit check.
