I haven't been pepper sprayed in my eyes but everyone of my friend's who has either been sprayed while they were locked up or in a crowd that got sprayed said their vision has NEVER returned to normal. I've been pepper sprayed on the side of my face because I closed my eyes and turned away. that shit burns like a motherfucker.

Her lawyer wouldn't have been prosecuting. Would've been the DA or some other attorney appointed by the state. But only 60k, yeah she could've gotten more.

On the grounds of resisting arrest.... Arrest for what?? One should not blindly follow orders. If most of us were in the same situation we probably would have gotten mased as well I bet. You can't place someone under arrest because you THINK you gave them a $20 and didn't receive the correct change. I mean damn. What if you tried to file a police report like that?? "Yeah I gave her a $20 and she gave me the wrong change, can you go arrest her??" "Sure and if she gives us any lip we'll go ahead and mase her 16 yr. old ass, hahaha" Yeah right. But since he has a badge he thought he would be Billy Badass and go back there and act like a tough guy. I'm sure that case was very famous in Ohio and the guy probably isn't even a cop anymore. I can't imagine all the shit you would get from people.

OK, I'll start with, Can someone show me a legitimate news source that says he wasn't disciplined? When this came out about 2 years ago, I was told he was terminated.

Now, having said that, let me explain a few points that most people, including many here, want to forget. When a police officer tells you, "You are under arrest" you do NOT have the right to resist that arrest. Period. You do not have the right to wait for your momma, you do not have the right to have your manager intervene. You are required BY LAW to obey the police officer, even if the police officer is wrong.

What we have here, other than an idiot cop, is a mentality that says you have the right to resist what you don't believe in. While, in most cases, I wholeheartedly agree with that, the simple truth is, the system has checks and balances in it that if the cop is wrong, you will still get off. Arguing with the cop will only make it worse. Do you REALLY want the law to be changed so that the cop is the one who makes the decision of guilt? Because, once the words, "You are under arrest" are spoken by a cop, the person is detained. The cop will take the person to jail and will use whatever force is necessary to accomplish that task. Once the person is in custody, the prosecution starts. That is when this would have been reviewed, and the clerk would have been set free. She STILL would have been awarded money (although, not as much) for the unlawful arrest, and he still would have been disciplined.

Now, as a side note, the only time you have the right to resist arrest is if the use of force being used is unreasonably excessive. In this case, he is telling her she is under arrest. She counters that with, "No I'm not." He then tries to escort her out of the restaurant. She resists that too. Next, he peppers her. He is escalating his use of force to accomplish something she is bound by law to do, and that is succumb to the arrest. Thus, she is making the situation worse, not him.

Finally, to clarify, I do not support this officer in what he did. He has violated several standards that I think would be more than enough for extreme discipline. Included would be: Getting involved in a situation where you are the victim (he should have called another officer). Pepper spraying someone in such a public place (he should have used other force to accomplish what he was doing. I mean, why not just go to a hospital and use pepper there too?). Most importantly though, not taking steps to insure his actions were appropriate. These are where he lacked professionalism in my opinion. But, I want to make it very clear, he would have still lacked several of these professional standards had she merely complied, which she is REQUIRED to do.

Where are the charges at. When someone is arrested (not detained) arent the officers required by law to declare what you are being charged with. He said "You are under arrest." I was waiting for something along the lines of what happened when i was arrested...he told me i was going to jail for disorderly conduct and public intoxication. Makes sense to me...i dunno about yall.

Yeah..... I guess I just don't like being a lemming. Because of Lemmings like that people like Hitler were allowed to arrest and exterminate large numbers of innocents.

In some cases, yes, compliance is necessary. For example, traffic stops.. general questioning by an officer, etc etc.. However in other cases you can't sit back and be a punk bitch. Just because someone is a police officer doesn't mean they have the right to put hands on you for any reason they please. According to the "founding fathers" of this country everyone has certain god-given rights. You can't let people tread on them. I am taking this argument to the extreme of course to better illustrate my point. Hopefully you understand that.
