Saturday night, me, my girlfriend, and my son are on our way to In-N-Out Burger. I'm at a red light in the middle lane. I'm at the front, there are cars in both lanes next to me and cars behind me. About 100 ft after the intersection the right lane ends so the cars have to merge into my lane. The light turns green and the car in the right lane takes off so they can merge in front of me. They get in front of me and in front of them I notice that there are a group of cop cars blocking off all the lanes going in the opposite direction, plus the far left lane on my side of traffic and one cop car is sticking out a little into my lane. So the car in front of me slows down and start moving over to the right a little bit so we can avoid hitting that one cop car sticking into our lane. All of a sudden he decides to slam on his brakes for who knows what reason, so my natural reaction is to move to the left and accelerate around him because if I slam on my brakes, the cars behind me could rear-end me and possibly cause a pile up.
We were traveling at about 30 mph and while I accelerated passed him I got to no faster than 40 mph (40 was the speed limit BTW) then all of a sudden i see two cop cars come flying up on me. So i pull over, take my license out, roll down my window, and while i ask my girlfriend to grab the registration and insurance, one of the cops walks up and says that all he needs is my license. So i give it to him and in his typical cop attitude he starts to talk to me like i'm a dumb ass and eventually asks me why I was speeding. I told him what happened (while speaking to him like he was a dumb ass because i'm not gonna let anyone talk to me like i'm some retard who doesn't know what's going on) and he says so "my solution was to speed up and endanger other people's lives" I told him that given the situation, I did what I felt was the best thing to do and that I never actually got above the speed limit.
He writes the ticket and still with his dick head attitude he hands me the ticket and says "red box please." I'm trying to read the ticket while his bright ass spot light from his car is blinding me through my side mirrors and he raises his voice and says "I said the red box" So i yelled right back at him that "I wanted to read and look over at what I was signing first." So I can tell he got irritated that i was right so he lets out a long exhale and shines the flash light at the ticket and points out what i'm being ticket for. It says "excessive speed through traffic accident" Keep in mind the accident is on the other side of the road and what I was trying to avoid was the retard who slammed on his brakes and get by the cop car sticking out into my lane.
So do you guys think i can win? I'm going to fight this regardless since the worst that can happen is that I have to pay for the ticket and there is no penalty for losing. Hopefully he doesn't show up and the ticket gets tossed out or the judge can see that I made a smart, good decision and tosses it out.
