is says it's set at 40psi from the box but is that 40psi with the vacuum hose on or off?

40 psi with vacuum line on and when you hit the gas, at idle it should be around 30 - 35 psi.
at least thats what my fuel pressue gauge say's, i just left my aem fpr stock from factory

i don't agree with aem either.
all fpr's need a vacuum source. honda ones are 1:1, meaning they don't rise disproportionate to vacuum (like fmu's do with boost)
it should be about 35-40psi at idle, and as you get more vaccum from more rpms and throttle, it raises the fuel pressure a little bit
