MA doesnt actually have the death penalty
from what i found it looks like they did away with capital punishment in 1984
there is a federal death penalty though and this case was tried in Federal Court (a federal court located in MA) not MA State Court so thats how the death penalty was on the table for this case
he has been sentenced to the federal penitentiary inTerre Haute Indiana (trivia: the same prison Timothy McVeigh was sentenced to and put to death at in the last federal execution in 2001)
and for what its worth, to sort of answer your question... since the federal death penalty was reinstated in 1988, 74 people have been sentenced to death, and 3 have actually been executed
